  • H1 to H4 COS

    I am currently on H1B and my visa expires on Oct 1, 2012. My contract ends and I do not have a new project/client yet. Hence I am planning to apply for COS from H1 to H4. My wife has a valid H1 until 2015. Please advice if I can apply individually by myself using Form I-539. And please confirm if I am eligible to e-file immediately. I am based in California. I think I can lodge in the application to the CA service center before Oct 1, 2012. Please advise. Thank you and have a nice day.

    It is your own application and can be filed at any time. You can stop working any time after it is filed. Once change of status gets approved, you must stop working.
