  • H1B Transfer

    I am changing company from A to B. I have already applied for H1B transfer and also received the receipt from INS. Now my current employer is threatening to cancel my H1B. Following are my questions?
    1. Can my existing employer cancel my H1B?
    2. If yes, then what will happen to my transfer application?
    3. What are the legal implication for this?


    I am working for this company for last six years and out of that last 2.5 years I have spent in US on H1B Visa. I also have payslips for last six month.

    If you have received the receipt # for the new H1 you are good! Under H1B Portabilty act you can start working with the new Employer as soon as you receive the receipt. However, you need pay stubs until the date of filing new petition fron new employer. If these are intact even your old employer revokes your H1, you will be in good shape!
