I work for company ABC on H1B Visa. My current project at the client location would end by September 30 2009.
My due date is Nov 18 2009. I was planning to taking either FMLA or Short Term Disability leave from October.
As per my conversation with my company, I understand that if the doctor certifies then I am eligible for either FMLA or STD leave. I have decided to go for STD leave as it would pay me during the leave.
My company says that I am eligible for 90 Days of STD Leave, but if these 90 days are taken at a stretch, even the weekends and holidays like Christmas etc., are included. I wanted to know if this information is correct? Can anyone please clarify this question of mine? Are there any agencies from where I can get this information validated?
Also, are there any disadvantages in taking STD leave instead of FMLA?
