    Hi,

    I am recently employed fulltime into Siemens. I graduated with a masters in Dec 2004 with OPT starting from 01/18/05. I am in the process of applying for my H1B with a start date in Jan 2006. I am currently working on my OPT (F1 visa 2002-2007). I heard that FICA(social security) and Medicare taxes are exempt for OPT status.

    Here is what my payroll department says,
    "He needs to provide document that states he is Fica/Medicare exempt under treaty from his home country in order for us to exempt him. His student visa is only effective if he works while he is in school and here on a temporary basis. Otherwise he is taxable for Fica/Medicare wages regardless of the type of Visa he is here on"

    So, I will need documents to prove that I am exempt from these taxes. I looked into the IRS Publication 519, but it does not say anything about OPT in particular.

    I would greatly appreciate any help in this matter.

    You are not exempt from FICA/Medicare taxes. You have to pay them, just like everyone else.
