Per Diem Rules: temp firm wants to reduce my rate and give a fixed per diem

    Temp firm wants me to accept a fixed daily per diem in exchange for a must lower rate (one third lower). With the per diem I come out slightly ahead assuming I work an eight hour day be lose significantly if I work overtime, because the per diem is fixed.

    A couple of questions:
    (1) I've heard colleagues talk about getting a per diem that is a percentage of their paycheck. Is this still done?
    (2) Isn't there some way to assign pre-tax dollars to the per-diem without the fiction of specifying a lower rate?

    BTW, I am currently a U.S. expat residing permanently in Mexico and will be going to Texas for the exclusive purpose of this contract, so I am very clearly entitled to a per diem.
