I am on H-1B and wife on H4 (doesnt work). I filed under Married filing jointly. My son was born in US and have an SSN. I am paying for my Kids child care services since Oct of 2015 and would like to know if that can be claimed under child care credit. I was told that since my spouse doesnt have an EIC and is not authorized to work, I cannot claim these expenses. Can someone please confirm
