    Hello,

    Me and my wife moved to US last year on April 1st. I am working and my wife is home maker. She have EAD but do not have SSN or ITIN.

    1) Can I file the tax as married without her SSN
    2) What are the steps to file the tax without her SSN

    You need to get her either SSN or ITIN.

    If she has EAD, she can get SSN.

      Since you are married as of December 31 of last year, you must file as married -- either Married Filing Jointly or Married Filing Separately.

      If filing as Married Filing Separately, and your spouse doesn't have an SSN or ITIN, per the 1040 instructions put "NRA" in the space for spouse's SSN or ITIN.

      If filing as Married Filing Jointly, you must provide the spouse's SSN or ITIN. Since your spouse has an EAD, she is eligible for an SSN and thus must use an SSN to file taxes; she is not eligible for an ITIN.

        Query regarding spouse (on L2 visa) eligibility for SSN

        Hi,
        My spouse is on "L2 visa". Is she eligible to apply for SSN number?

        In case she is eligible, then which checkbox should she check in section (5) :
        (B) Legal Alien Allowed To Work
        (C) Legal Alien Not Allowed To Work

        Please suggest

        (Note : She will not be applying for EAD)
