  • R2I and Surrendered GC in 2017 - do i need to file FBAR for prior year

    Hi,

I had a GC for 2 years and retured to India in July 2016.
I surrendered my GC in march 2017 by filing the i407.

1 - whats is the date till which i am considered a permanent resident of US - is it July 2016 (my last day in US) or March 2017 ( when i filed i407)
2 - Do i need to file FBAR in 2017 now for the financial year 2016. I am no longer a GC holder , however was a GC holder during the financial year 2016.

    thank you

You are a US permanent resident and therefore a US tax resident until the filing date of your I-407, Record of Abandonment of Lawful Permanent Resident Status

You have a full-year tax return filing and FBAR filing obligation for 2016

You will have a part-year tax return filing, and FBAR filing obligation for 2017

In addition, you will have to file a Fom 8854 with your 2017 tax return if you were a USLPR in at least 8 of the last 15 tax years
