    Hi,

    I was a L1 visa holder and moved out of USA in 2007. I had couple of traditional IRAs that I closed when I came for a short visit in 2008.
    They have deducted tax at 30% and I was not able to furnish the W-8 BEN in time. I have applied for tax extension and I have time till October.

    I did not have any earnings in 2008 other than the withdrawal of IRA.
    Would I be able to get the tax deducted back. What form should I submit?
    Appreciate if someone could throw some light on this.

    You should have been able to claim the withholding shown on your 1099-R. If you didn't, you have 3 years to amend your return and get a refund.
