    Hi,

    I came to US in August of 2007 and was on F1 student visa till August of 2009 and I'm currently on OPT (since Sept2009). As an F1 student I was getting paid by the university. During Sept09 I moved from one state to another(job related).

    1) What are the tax return forms I would need to file for 2009?
    2) What should have been the tax forms used for years 2007 and 2008?
    3) When do you qualify the substantial presence test in US?

    Generally, you qualify for the substantial presence test and are allowed to file a regular 1040 if you are present in the US for 183 days. When counting the 183 days, you cannot count the days you are present on an F-1 visa.

    F-1 visa holders will file a 1040NR or 1040NR-EZ.
