    I am from India and came to US in Aug '04 on an F1 visa. I have graduated in Jul '06 and my OPT period was from Sep '06 to Sep '07 and my H1B started from Oct '07. But, I started working at XYZ company from Jun '07. XYZ has not withheld my FICA taxes (Social Security + Medicare) ever. My friend noticed my W2 yesterday and informed me that XYZ was supposed to withheld my FICA taxes starting from Oct '07.

    So, what should I do now? Who is at fault? Am I liable for all those FICA taxes since Oct '07? If so, how will they collect it from me? All at once or in installments? Is there an option of not paying at all? Will I be in trouble in the future during my Green Card processing in the future?

    Thanks in advance for the help.

    Lucky for you its XYZ Company's fault. XYZ would pay the penalty and interest. The Company might ask you to repay your share of the social security and medicare. I would get it cleared up before applying for the green card. It might raise some questions.
