Hi, I am in the process of assisting a family member with a business venture of his which will require me to move to the USA to oversee operations there. There are some questions which
I would like answered if possible :
1. Can one study while under an E-1, E-2 or L-1 visa?
2. Which would be better - a E-1 or E-2 visa? The company has not actually been incorporated in the States yet.
3. Do I need to be the one to incorporate the actual company, or can I be an employee of it?
4. If I am considering a H1NB Visa instead, will my lack of a university degree be an issue? Can I state that the company requires my services despite the lack of traditional
qualifications?
5. Would it be possible or advisable to change from the E class of visas to the L class, since the latter is eligible for a green card and the former is not? I have actually received
conflicting information on this...some people tell me that it is possible under dual intent for a E class visa to apply for a green card sometime down the road, and some tell me that
only an L class visa is eligible. Could anyone clear this up?
