  • H1 approved in consular and L1B approved

    HI

I have got my H1B in consular approval(without I94) from company Al till Sep 2014 and I also have my L1B (with new I94)approved from company B until Sept 2013.
Do you think that company B can force me to join their company? Is it illegal for company B to retain my H1B for 2-3 months when I am working for company A on L1B?
Actually many of my personal things would clear by Dec end/Jan 1st week and till then I want to ask company A to hold my H1B and not revoke but just wanted to get it clarified.
Can I suggest company A to retain my H1B for 3 months legally and then I would join their company?

I hope you are currently working for Company B on L1, which expires in Sept 2013.
And, you got an H1 from Company A which is approved for consular processing.
Since the H1 is approved for consular processing, you can continue to work for the L1 employer as long as you wish until it's expiry.
H1 employer cannot force you to join them, but they have the right to revoke that H1.
So, you need to work with the H1 employer and decide a join date feasible for both parties, then you can leave US and come back after H1 got stamped.
You can delay the joining date of H1 employer, but you and employer should come to a mutual understanding on that.
