L1 to H1 Transfer

Hi,

I'm working for company 'A' thru L1 and seeking H1 transfer. I had a valid H1 petition in 2008 but did not go for stamping. So in a way it is expired in Oct 2011. Can I apply for H1 transfer regardless of CAP using this expired H1 petition ?
