  • L1B extenion query

    I have a valid L1 Blanket VISA till July 27 2013. Today I applied for my Visa extension. My company will start the process, I don't know when they will submit my papers to U.S. Embassies. But unfortunately I need to travel to INDIA in the month of Feb 2nd week 2013 and will retrun in the month of march 2013.

    My question is

    is there any problem with my extensions since my I94 number is changing and also is there any problem at the port of entry when I returns since I have a 3 months left to expire my VISA

    If you are not planning to apply to attend the visa interview during the trip to India then there is no point applying for extension and then traveling to India. Suggested to apply for extension only when you dont get an I-94 valid for more than 6 Months validity when you return to US after your trip to India.

    In any case, after July 27 2013, if you travel outside US, you need to get a new visa stamping done in order to enter US.

      When does your I-94 expire? Like above, it is better to apply for extension of status (not Visa extension and it is filed with USCIS not US Embassy) after you return or travel after extension is approved. If this is a blanket petition, you will get 2 years I-94 after returning and there will be no need for extension.

        Similar situation

        My L1B visa and I-94 expires in Oct 2013, I am planning for vacation in Aug 2013 and will return in Aug itself. 3 questions I have.

        1. Will i be allowed in POE considering my visa is valid only for 4-5 weeks after Aug 31
        2. Is 4-5 weeks of time is enough to apply for extension if the new I-94 is valid upto Visa expiry date, Oct 2013.
        3. What will be minimum validity period of I-94?

          You can return on your existing visa till visa expiry date in Oct 2013 and might require to apply for extension based on the new I-94 that you receive. If you receive I-94 with validity for more than 6 Months you cant apply for extension till 6 Months before expiry.If you receive it only till Oct 2013 then yes you will have to apply for extension.

          2. It depends upon your company and lawyers but guess it should be enough.
          3. There is no defined rule, it depends upon the immigration officer at the POE. Generally the earliest of Passport expiry, visa expiry, petition expiryo r sometimes for L1B 3 years in future.
