  • L1B denied, employer now filling via premium processing

    My L1B visa got rejected on Jan-10, the US petitioner is now applying for L1B visa premium processing. Every where i read it says that with in 15 days approval notice or denial notice will be sent. Does this mean that I-129 will be approved all i need to do is go to Chennai consulate show them the approval and get visa on the passport. Or will the process be same in India as for the regular L1B visa. Can the consulate in India still reject the visa application even when its applied via premium processing. And do we still have to pay the fraud detection fee of $500?

    Petition, Visa, and I-94 are 3 Different things.

    Premium processing just reduces the processing time of the petition, but if there are RFEs then the processing time can be more than 15 days too.

    If approved, you should take the petition and I129 along with the standard L1B required documentation to the Consulate for a L1 B stamping interview. Also, the Consulate can still reject the visa application even if the petition was approved/filed under premium.

    With an approved and stamped visa and petition one can try to enter US the duration and validity of stay is determined by the officer at the Port Of Entry by giving the date on the I-94.So, even with a valid petition, and valid visa one can be refused entry into US at the Port Of Entry.
