  • L1 and L2 expiry dates differ

    My husband's L1(and i94) expires in July 2013. I & my daughter are on L2 and it expires on June 2013, a month earlier. i94 also expires Jun 2013. We are planning to go back to India when his L1 expires. i.e in July 2013. Can we stay with him for a month and depart together in July 2013.

    Additional Info:-
    I was previously on L1 and my L1's i94 date is Sep 2013. Is it still valid to be considered to stay in US? I am not working.

    Didnt you convert L1 to L2 as COS initially?

    I am assuming you and your daughter are on L2 status right now so L2 I-94 is your valid date and since its expiring in June 2013 either you can file an extension request to match your spouse's July 2013 I-94 date OR leave before that date .

    Without applying for extension you cannot and should not stay beyond your June 2013 date.

      You need to depart as per your latest I-94. You can file an extension for 1 month if you wish.
