L-1 B expires by Jun 2013. Is my stay legal if applied for 2014 H-1B

  • L-1 B expires by Jun 2013. Is my stay legal if applied for 2014 H-1B

    My L1-B, I-94 and Petition expires by June 2013. My current employer may not file L1-B extension. New employer filing H1-B. Kindly please answer for below queries.

    1. Is it legal to stay from Jun 2013 to Oct 2013 with H1-B filing number?
    2. If legal, if H1-B rejected what will be the next step.
    3. OR can i give a try to visit neighborhood countries (Mexico / Canada) to check my luck to see whether i may get I-94 date > Visa Expiry Date?

    1. No. Without valid L1 extension your stay from June 2013 till Oct 2013 is not legal.

    You can certainly try your luck by traveling to Mexico/Canada before June 2013 and hope that you get an extended I-94.
