L1B to L1A Conversion MNC

Hi,

I work for an MNC and came to US on L1B on a client propitiatory skill. I was working for that client using the tool till Jan 2012. Then I got transferred to a different client project and using my employer specific specialized knowledge and also got promoted to a managerial level.

I will be travelling to Canada for my L1B to L1A conversion since I got promoted to a Managerial level and the specialized knowledge in my petition is that of my employer specific specialized knowledge since I have been using that in India from 2005 and also on my current project.

Is there a risk for my visa extension considering my situation?

In order to successfully apply for an L-1B to L-1A conversion, your employer will need to proof that your employment outside of the U.S. was in a managerial role for at least 1 year out of the 3 years BEFORE your intra-company transfer.

You do not need to travel to Canada for that petition. You would only need to travel to Canada if your current visa stamp is expired or will expire soon. It is important to realize that the L-1 stamp in your passport can be used after your L-1B to L-1A conversion as well, as long as it is still valid.
