  • Please help regarding L1-B extension

    Hi, I am on L1 which is expiring Jan 2014. My husband is on L2 and recently renewed his EAD, which has given till Aug 2014, even tough our I-94 is till Jan 2014.
    My company generally file L1 extension in last min to buy sometime, if there is any chance of rejection, so that we can buy the 240 days of time until the extension process is done and we hear final result.
    But as initially I thought my husband's EAD would be given till Jan 2014, I asked my company to process my extension sooner to make sure, he is not out of work.
    But now as the EAD is till August 2014, as we have time, people are suggesting me to go for extension in the month of December 2013, to buy at least 5 more months of time.
    My question is, is that the right approach to follow?
    If we are on our extension process, and as my husband is having valid EAD, but not valid I-94, can he still work?
    What is the best solution for this.

    Please guide me.

    Your Spouse's L2 EAD till Aug 2014 may have been a mistake as EAD cannot go beyond I-94. For L1 it is ok to work while the extension petition is pending but for L2, as the spouse status is dependent on the L1 and as the EAD eligibility is in turn dependent on the L2 validity, it is suggested your spouse does not work after I-94 expiry, rather await the new I-94 after L1 and L2 extension approval and get a new EAD.
