Among many other forums I browsed, I think this is the place where I get detailed explanation of problem resolutions.
Following is my situation and need immediate help/suggestion to resolve these issues:
1. Currently, I am on L1 B (my spouse on L2) which is expiring on 7 Sep 2013. Both I94 and Visa has same expiring for L1 and L2.
2. On the other hand, I have approved H1 B petition and Change Of Status (Recently, I came to know about COS before that I had impression that it is not COS) effective
1st Oct 2013.
3. My current employer is going to file L1/L2 extension (I can get it filed in Premium if there is any benefit?)
Questions:
Q1: My Current visa - L1 expires on 7 Sep 2013 and H1 COS is effective from 1st Oct 2013. So based upon application, Is my stay in US legal from 7 Sep to 1 Oct?
Q2: Can we file H1 COS amendment and get it changed to H1 - Consular processing? I heard it is possible. If H1 employer/attorney is not ready to file this, Can I file this amendment by myself with help from other Attorney?
Q3: I want continue on L1 till Jan 2014 and then join H1 employer. What are my options in above explained situation?
