L1B and Business visas are rejected

  • L1B and Business visas are rejected

    L1 blanket is rejected in Oct 2011 and Business Visa is rejected on Nov 2012.
    But in Sep2012, I got L1A Individual petition and will be expired in 2015. Based on my project's requirement my manager applied for business visa also for me and it is rejected in Nov 2012.
    Now can I go ahead with L1A individual petition for the stamping. My question is, will my previous rejections impact my L1A stamping also.
    If these impacts my L1A stamping, my company is ready to initiate for H1B also. Can I ignore L1A petition and go ahead with H1b?

    Can you please help in this regard.

    H1 cap is closed and next one wouldnt be effective before 01-Oct-2014. So you have 1 Year to try other options. I would say try your luck with L1A visa interview too, if doesnt work out try for H1 next year.

      Thanks for the reply.
      My doubt is I got the L1A petition before business petition and my business visa got rejected.
      If I go with L1A now, they may ask why did you come for business Visa even you have L1A by that time.
      Already I got two rejections. So I am scaring to go with L1A.
      Please advise.

        Well getting scared is of no use. Each application is treated on its merits.

        Yes, with L1B rejection and B1 rejections in the past, there must be something not begin done correctly.

        If company was so keen on sending you why they didnt process H1 in April 2012 or April 2013? It would have been easier.

        The decision is yours its either you try it or wait till next year to try H1.

          One last question.
          If I go with H1b next year, will they (US consulate) have any record regarding my L1A petition for which I did not go for the interview.
          Do I need to go for H1B interview after my L1A petition expiry date only?
          Can you please advise.

            Consulate has all the records as well as resources to get any. If they doubt a case too much they may outrightly reject.

            But I dont see any reason why your past rejection or L1A petition will hinder your H1. You can attend H1 interview upto 60 days before start date , no need to wait for L1A petition expiry.
