When did your visa expire and when is your I-94 expiring?

Approximately 4-6 Months under normal processing.

You can work with your L1 employer till your current L1 I-94 is valid. If your I-94 has expired and extension was filed before that then you can stay and work till 240 Days from I-94 expiry if no decision is made.

But if you leave US, you will have to get a new visa stamping done in order to return.

This is my opinion not legal advice.

      L1B Extension

Lets assume L1B extension has got RFE and I will withdraw the extension after 2 months. In this case, will my stay after i94 expiry be considered as illegal?

            Hello, Vb55490.

If, after expiration of visa, the visa extension petition is withdrawn, then you will have NO status. Isn't it? If you withdraw the petition, what status will you assume? Your L1B status has already expired.

Anyway, in the event of withdrawl of this petition, you will be Out of Status and you will have to leave the USA.

You could marry a US citizen and then you being Out of Status would not matter and you will get a GC in no time.

            I hope this helps.

            Wishing you luck.

            Cheers,

                Hello, Vb554...

Yes. In the event of withdrawl, i feel, you will be considered Out of Status from the day of your I94 expiry.

Also, i do not feel you should worry about future entries / applications for USA. The fact that you filed a bonafide petition for extension will go in your favour, not against you.

                Hope this helps.

                Wishing you luck.

                Cheers,

Extension filing is to extend ones stay while in US. If one files it and leaves it is technically of no significance as you will be submitting the I94 at port of exit.

Thank you. My application is in "Initial review" status from sept 24 onwards. Is it signal for RFE? Anyone waiting for similar case?

Hello, did you get any response from USCIS on L1B extension? Mine was filed on 27th August and still my status is showing "initial review".

My L1-B extension was applied on 4th Oct and it is showing "Initial Review".
The website says that the processing time is 2 months for L1-B extension.
Does anyone have any idea when it will happen?

                              L1b or 94 extension

                              Hi,

I am on L1b - which expired last year (visa was valid for 3 years). I was given an extension on my I94 as I entered US after 1 year of visa approval. My question:

1 -- how can I extend my stay in US? My I94 will expire in June 2014
2 -- Can i get my I94 extend again - as L1B is valid for a duration of 5 years.
3 -- When i filed for my extension on I94 - the expiry on my passport was june 2014 - i have a new passport issued by Indian embassy valid for next 10 years.
4 -- If my employer files for my H1B in april 2014 - and my I94 expiring in June - can I get my stay extended based on my pending H1 case? or will I have to leave US in june 2014.

                              Thanks,
                              Sana
