  • Moving from L1-B to H1-B under another employer without Quota using expired H1

    Hi,

I have started my travel to US since 10/23/2005 and has worked for about 30 month on H1-B. After my H1-B got expired, I worked on L1-B for about 22 months till date. My entire stay in US comes to 52 months with current employer.
I am in US now and working on L1-B. Can I move to H1-B under a different employer who is also ready to file the GC immediately without waiting for next quota availability?

Here are the dates of my stay in US -
Start Date End Date Status Number of Days
    10/23/2005 11/08/2005 H1-B 16
    06/25/2006 03/04/2007 H1-B 252
    03/13/2007 12/13/2007 H1-B 275
    01/21/2008 12/30/2008 H1-B 344
    05/09/2011 11/14/2012 L1-B 555
    07/29/2013 08/08/2013 L1-B 10
    09/03/2013 09/24/2013 L1-B 21
    09/30/2013 11/21/2013 L1-B 52

    Thanks in Advance

H1+L1 can be for 72 Months so technically what you are saying is possible . You would need a good lawyer to draft the petition and gather the evidences , you need to provide evidences of the above dates stay along with the old H1 petition details.

This is my opinion not legal advice.
