These are my details:
L1B visa valid till 16 Dec 2013
I-94 valid till 16 Dec 2013.
My employer has filed L1B extension in November 2013 and the decision is pending with USCIS.
Now, I need to travel to India for a personal emergency in Jan 2014 and planning to come back to US by March 2014.As there is no certainity on my L1B extension approval(it may or may not go to RFE), I would like to go for L2 visa stamping during my stay in India since my spouse has a valid L1 visa.
Please clarify the below:-
1.Can I go for L2 visa stamping when already L1 extension is pending? Will this cause any issues in the stamping and are there any chances of stamping rejection?
2.or Do I have to withdraw the L1 extension before going for L2 visa stamping?
Please provide your inputs on this ASAP.
