  • L1B Visa Extension Denial

    Hi,

My I-94 expired on 6 Nov,2013 and my company filed my extension on Oct,31,2013.
I got RFE on 12 Nov,2013. I am surprised that with in 13 days I got RFE. Now till 4 feb,2014 I have time to respond.

My Question:- If my L1B got rejected e.g 10th March,2014 then Can I stay 25 days after rejection. I heard that we can stay max. 30 days. But I am not sure about that.
We need atleast 25 days to sell everything. If we stay 25 days then will it be legal? Also what I have to do to stay for 25 days. Do I need to send any document or simply after denied, I sell everything and booked tickets after 25 days from Denial date and leave.

    2) We should count 25 days from denial date which will be updated online or once we will receive hard copy from that date. e.g if online denial date is 10 March and my company received notice on 20 mrach then I have to count 25 days from 10th march or 20 March.

    Please suggest me

I don't know where you getting this 25 days number from. There is no such thing. Typically you should leave ASAP but USCIS generally mentions in the rejection notice that you should leave within 10 days of rejection.

This is my opinion not legal advice.
