Apply for Fresh L1-B after L1-Extension got rejected.

If my application for L1-B extension while in was in US gets rejected can i go back to India and apply for fresh L1 Visa immediately ?
In my case I have overstayed for almost 45 days after my L1-B Visa /I-94 visa expiry to wait for a decision from USCIS.
I had applied for my L1 Extension 3 months before the expiry date for L1/I-94 (both were same).

Yes you can apply but the chances are low. Recommended to go for L1 Individual or h1B.
