    Hi,

    My I 94 is expiring at the end of March 2014 same date as the visa. I filed for extension on December 18th and on Feb 11, got an update on USCIS site stating that they have mailed a denial decision notice. My company is suggesting i can go ahead and file for second extension as i still have time.

    Please let me know the best option of the below two, as i received a denial notice on first instance, so i have a better success rate of getting visa.

    1. Apply L1B extension for the second time, as suggested
    2. Applying for a new L1B, so when i reach India, i can attend interview in April.

    What was the reason for denial? Applying again for extension when already denied once may not be a good idea. Going out an applying new L1B seems a better option.

    As for chances, no one can predict.

      Hi,

      Thanks for the reply.

      If my company files extension for the second time, during the same time when the extension is under review in USCIS whether we can file a new H1B petition, so even when i go back to India, i can attend H1B interview (if i got the lottery), sometime after October.

      Please let me know if that is possible.

      Also let me know how long i can stay in US after my I-94 is expired, while the USCIS review of extension is in process.
