  • changing attorney while under RFE

    I am the beneficiary of the L1A application for new startup.
    we received an RFE from USCIS

    I am not sure if the current attorney did the right job or USCIS now hands out RFE's lot more that normal

    I want to discuss with another attorney or change the attorney, is it possible at this junction that the response is filed by a new attorney?

    RFEs, especially for L1s are much more common since last 3-4 Years than say 5-10 Years back. As for RFE response , do you have the RFE provided by USCIS? Changing Attorneys would need the G-28 filed with USCIS.

      yes I have the RFE.

      one of the points mentioned is

      "The submitted lease agreement is insufficient to establish that you have secured sufficient physical premises to house the new office since it does not provide any information about the space rented apart from the office number and the amount of the rent. Additionally, the lease is valid from February 2, 2014 to July 31, 2014 and it is unclear if you will have access to the rented premises after July 31, 2014. Therefore, the record does not establish that you have secured sufficient physical premises to house a new office of six individuals for the first year of operations. You may still submit evidence to satisfy this requirement.


      MY Response
      We want to look for a suitable new space after operations are started. We can find additional spaces in the same building and/or we can look for another larger space after some more people are appointed so we took initially a 6 months lease which can be extended or we look another space

      how to explain above point?
