  • L1 and L2 status change to F1 within the US: multiple or separate application?

    Hello everyone,

I hold a L1 visa - Brazil expat working for J.P. Morgan in NYC - and my husband holds a L2 with a work permit as he is finishing the first year of a PhD with full scholarship.

I will also start a PhD in the Fall. Because of that, both my husband and I need to request a change in status to a F1. We both have a I-20 form and so, SEVIS number.

However, it is not clear to us if we need to do two separate forms, with each of us using the option in the I-539 of "I am applying for a change of status and I am the only applicant" or if we need to make a joint application through the option "Members of my family and I are applying for a change of status and we are all seeking the same benefit".

While the second option of the joint application seems convenient, when we go through the form we noticed that there is room for only one SEVIS number, which we thought it was weird.

What should we do? Joint application or two separate ones?

    Thank you,
    Laura

    It should be separate applications.

This is my opinion not legal advice.
