  • I94 Extension after passport renewal

    Hi
We got electronic I94 when we entered US (I am in L1A and spouse/kid in L2). my Wife and Kid's passport were expiring this november and their I94 carried the passport expiry dates. now that we have renewed the passport, i was planning a trip to Canada to get I94 extended (visa valid till Apr 2016). but have a couple of queries
    1. while i had electronic I94 at entry, will it be paper based when i return>
    2. i read in some forums/responses that less than 30 day travel to Canada would not get I94 re-issued. is there a way i could request the CBP at POE for reissuing or is I94 reissued automatically?

Any recent experiences on I94 reissue at Rainbow bridge will help.

Alternatively, if it is a tedious process getting it by land travel, will an air travel to Toronto make this easier?

request your kind info and help in clearing my doubts.. all the older queries on this were paper based and it was said that paper would be taken, now that i dont have any paper based, looking for latest experience and suggestions..

    Thanks.

    Hi morekuzambu,
I am in a similar situation myself; just that in my case its my own electronic i94 which is expiring this November.

Even I did a lot of research on this but I haven't found anyone with an electronic i94 share their experience on renewing it.

I am located in NY-NJ area, and I am doubtful if any CBP officer would agree to help out; so am thinking about either going to Toronto by flight or going to the Rainbow Bridge. I still don't have my renewed passport yet after which I would be applying for a Canada visa.

But would definitely help if someone with an electronic i94 recounts their experience.

Were you able to get your job done by the way? If yes, can you share your experience please?

    Thanks

Hi this Nikhil. I just got my I-94 amended to the original date of my visa. My visa is due to expire on Sept. 30 2016. My old passport expires on Nov. 27, 2015. So when I came to US from India this March, 2015, the CBP officer changed the visa date to passport expiry date.

I had to re-issue new passport from Indian Consulate in Houston (as I stay in New Olreans, LA). I just received my new re-issued passport. I went to local CBP office at New Orleans International airport. A flight was about to depart so the CBP officer were engaged in flight departure activities and therefore the wait time was 45 mins. The officer came and asked what he can do. I explained him the situation and he got it quickly. He took the both passports inside and verified the information. He asked d me if I have I-129 which I didn't. I showed him the I-797 which he took as the evidence for I-129.

Soon after he came back with the print out of the changed I-94 showing the stay extended and matched to what was on the visa. He was courteous about the whole process and took at the most 15-20 mins.

Let me know if anybody has any questions about the whole procedure.

        Thanks,

        Nikhil.

I-94 Extended after passport renewal in San Diego border without passing the border

Here it is my experience which was unique in some sense:
I entered the country in August 2016 on H1B petition which was valid for three years up to 2019, but the officer issued I-94 till the expiration date of my passport which was April 2017 at the time. To have peace of mind with my stay here I wanted to extend the I-94 now rather than leaving it till April 2017 when it is going to expire. I also had reservations because my H1B entry visa was single entry as it is the case for citizens of very few countries not having good relations with US. So I was not sure if I could extend the I-94 while my single entry visa is used and expired already. Actually, my employer told me that the only way for me to extend I-94 is to leave the country and apply for another entry visa and enter again and extend I-94 while passing the border with the new single entry visa. I was scared to follow this option because it might take months for me to get another entry visa to be able to get back into the country (again because of my citizenship) and it would endanger my job here.
Anyways I renewed my passport and I spent two days reading forums, and visited local CBP and they said I should visit CBP at either Mexican or Canadian border and they should be able to extend I-94. So once I was visiting friends at Los Angeles, I drove down to the Mexican border down San Diego on mid November 2016 and parked at McDonalds close by. Less than five minutes walk and I was in the CBP building right on the border. YOU DO NOT NEED TO PASS THE BORDER, as I did not do so. The building is here:
SENTRI / Global Entry - Otay Mesa Enrollment Centre.
2500 Paseo Internacional, San Diego, CA 92154
You walk right into the building, pay 6$ at the cashier window, then you can see the room for permissions and I-94. You get into the line if there is any (not much line in my case) and when it is your turn the officer asks you what you need. It was about 11:00 am, all officers were so young and the lady was kind of confused to see my visa is single entry and it is used already (expired). She was nice and helpful, she asked many questions about what my job is and when I entered the country and like that, she consulted with computer and couple times with her supervisors. After 10 min the supervisor (who was young too) came to me and explained that he cannot override the decision of another officer (the date on the stamp on my old passport) and extend it right now because the stamp is still valid for five months. Fortunately he did not have issue with single entry visa, but he said I should get back close to the expiry date so he can extend it. But it is interesting to see they can be flexible on it if they like. So he first said I should get back within 10 days before expiry of the I-94, they when I explained that my boss needs to make sure I will be available to work for them from now, he said he could do it in Feb 2017, then he said even in Jan 2017 should be fine. After watching me desperately asking for extension now, I could see the officer was really on the fence to give me the extension, and the other officer was kind of encouraging him to do so too. Anyways he asked me to come back in January or late December. In the middle of the conversation, I learned that their shift is changing at 2:00 pm. So I spend three hours in San Diego and came back at 2:30 pm the same day to see if I have any chances. I had to pay $6 again. The officers were all new and also older and more experienced they seem. To my complete surprise, the officer asked no single question, scanned the old passport and stamped the new passport with the new date and extended the I94 up to 2019 which is the date for my H1B approval. I checked it online when I got out minutes later and I could see the change online. I was speechless by how different it was with different officers (all officers were extremely nice and helpful though). So even if you had trouble with one officer you should RETURN BACK ANOTHER TIME TO SEE ANOTHER OFFICER and there is good chance that you will have totally different decision made.

Hi I am on H1 VISA. MY Kids I-94 is matching with their passport expiry. I applied for their passport renewal at Chicago consulate, but its still pending with them. I am worried if their I-94 will be expired before I get the renewed passport. I-94 is electronic one. Any suggestions on this will be great help.
