    Hi,

    This is urgent coz my L2 visa is expiring on Oct 23, 2014 but have valid I-94 till 2016.
    My spouse's L1 visa and I-94 are expiring on Oct 23, 2014.
    My spouse's company is not filing for extension. That means he need to leave USA before his visa expires.
    I have a 6 month old US born baby and dont have a visa for him yet to go to my home country but have started the processing.

    My question is can i stay here till i get my baby's visa approved?

    Why does your spouse need to leave US when the I-94 is valid till 2016? Is his employer asking him to leave?

      Hi,

      Ohh, i made a mistake.

      My spouse's L1 Visa and I-94 are expiring on Oct 23, 2014
      Mine L2 Visa on Oct 23, 2014 and I-94 in 2016.

      I will update my query now...

        In that case, unfortunately, you will have to leave too as without L1, L2 does not have much significance. If there is a possibility, ask employer to file L1 extension while you sort the visa situation for your kid out. And its already been 6 Months, why delaying child's visa process?
