    Hi,

    I have a question that need help.

    My L1B Visa will expire on 5 Aug 2017. And on the Visa said "PED 30 Nov 2014"

    My I 94 also stamp until 30 Nov 2014

    My I797B said Valid from 14 Aug 2012 to 30 Nov 2014

    I already submit to extension my Visa. Until now the USCIS still review on my case.

    My Question is

    1. Do I have to leave USA before 30 Nov 2014 If the Extension still under consideration ?

    2. If the Extension already approved, Do I still need to leave USA because I 94 expire on 30 Nov 2014 ?

    3. If I can stay longer, do I need to let immigration know about the extension approval ?

    1. As you applied for extension before I-94 expiry, you can continue to stay till a decision is made or till 240 days from I-94 expiry whichever is earlier
    2. If extension gets approved you would receive a new I-94.
    3. Which immigration? Extension is granted by USCIS so they will already know about it. Doesn't your own immigration team know about I-94 expiry?

      Thank you so much for your advise.

      However, may I ask you that if the I-94 Expired already. And the L1B Extension still under Review processing. Can I leave USA to Aboard during that moment ?

      Right now I think I cannot leave USA to anywhere because I did not have any new I-797B to show the immigration for an extension when I entrance to USA again. I only have an old one which already expired.

        Technically you can re enter showing the extension receipt but its never advisable to travel while extension is pending.

        If travel is really urgent, then I would suggest you upgrade the extension to premium and get a result quicker.

          Out attorneys said the same thing while we were waiting for the result of our extension, that is was not advisable to travel out of the US.

            Do you know how long it take for review after Submitting Extension paperwork ? Compare between regular and premium.

            I already submit as regular since early OCT. I am thinking about pay more for Premium now. My Lawyer said I can pay the premium anytime if the Case still in Review Processing
