  • L1 petition from B1/B2 Visa

    Hi -- Please I need your advice on the best option to consider. I am currently working for a company based out of the Philippines for more than a year. I am in the US now under B1/B2 visa. I was advised by my Management that i should consider not going back to the Philippines and have them process my change of status to L1. They said that the downside is that, I won't be able to go back home until the US Immigration folks reaches a decision.

    I wonder if this is the right option to go to or I should go back to the Philippines instead as I was told by a good friend that there is a 1 year requirement residency in my home country as part of the qualification. Please can you enlighten me. Thank you in advance.

    If you were working in Philippines for that company for at least a year and have genuine specialized skill set , yes, it should be possible for the company to file a B1/B2 to L1 COS. Ask them to file in premium that way you will get a much quicker decision.

      You mean at least a year employed by the company or should i spend at least year in the Philippines? Thanks.
