L-1A Visa Expired 30th Jan I-94 Valid till 2016 7 years complete Feb 2016

Hi There,
Here is my case:
[]L-1A Expired on 30th Jan 2015
[]I-94 valid till Mid month of 2016
[] 7 years completing in Feb 2016

I know i can legally work in USA till the 7 years completion, and I am continuing on I-94 Only. My question is can the GC process be started on basis of valid I-94 OR it is too late?
I know I am eligible for EB1 category, however the employer does not want to file in EB1 Category.

You EB1 is tied to your L1A. While you can legally work till your I-94/ MPS, whichever is lesser, you will not be able to initiate EB1 at this stage. The only option you are left with now is the one year cooling period .

Can't he apply for H1B visa and than for a green card instead of 1 year cooling period?

For H1B, Labour Clearance for GC can take an absurb amount of time. On the other hand, L1A can be obtained again after 1 year, and EB1 can be initiated easily.

Its a choice an individual needs to make for himself
