  • L1B max out & cycle reset

    Hello. Instead of applying for extension on the current L1B i preferred to go to Canada last year and got the new L1B. Now i have L1B until 2019 but due to max out of 5 years on my L1B i have to go back to my home country in next month. Do you think after one year, resetting my cycle I can still utilize the same L1B visa to enter back in USA or that L1B becomes inactive and I would have to apply a new/fresh visa?

    Granting a 5 Year L1B when you are already maxing out was a mistake by the consulate, but then they may not have the time/resources to track and validate the time spent in US, as generally that is done by USCIS. Did you use L1B individual or blanket? What is the end date on your I797?

      I use L1B Blanket. i 797 is until 2017
      Do you think I should continue stay in US even after 5 years max out as my PED is 2017 and Visa end date is 2019. And i94 is also until 2017

          Ideal thing would be to keep your immigration records clean. I wouldn't advise staying in US for more than 5 Years on L1B even if you have a valid visa, I94 and I797. They may have made a mistake but they will eventually find out and may eventually make you illegal retroactively.

              Hi Raghvi. Now I am back in India.. So after one year resetting my cycle, am I allowed to work/live in US utilizing the same/current L1B visa or I jave to apply a fresh new visa for the next year?

                  After completing 5 years in US on L1B now I'm back India to reset the cycle. The question is I should still be utilize my existing L1B that I got from Canada in 2014 to travel US in 2016 after completion of 1 year outside US?
                  And what if I go for a new H1B in 2016, shall I consider I should be able to stay & work in US on H1B for the next 6 years (considering the cycle got resetted)?
