    Hi,

    I am on L1B Blanket visa and it's getting expired on Sep 16, 2015. My wife is expecting and baby is due on Jul 5, 2015. If I will do expedite process also I can get his US passport by July end then I need to apply for his OCI and for which there is one condition that parent's visa should be valid at least for 3 months. I've inquired with OCI customer care also and they told they will not accept the form if my visa is not valid for at least 3 months. I've applied the extension so if my extenstion will be rejected what shall I do? As I need to leave the country and go back to India and baby will be not having OCI. Please suggest me, I am feeling helpless.

      Is it possible to get the baby a tourist visa, then apply for OCI from India?

        Thanks for your suggestion but I am not sure whether I will get the visa for my baby if my visa is not valid for at least 3 months.

              I didn't get you, if I'll just apply US passport for the baby then how would he go to India?

                She has two Indian citizen parents, why not get her an Indian passport as well?

                  You mean to say that both US & Indian Passport or only Indian Passport? How can I get Indian Passport?

                    Contact the consulate general. The one in San Francisco offers rush service. To be eligible for citizenship, the foreign birth must be registered with the consulate before the childs first birthday, and she must not have already received a passport of a different country. I think they will ask you to sign an affidavit stating as such.

                    Even though Indian citizens are not permitted to gain another citizenship without losing their Indian citizenship, Indian citizens are permitted to maintain all citizenships acquired involuntarily at birth until they are 18. They will then need to renounce either their Indian citizenship, or all other citizenships.

                    I am not an Indian citizen, so I do not have experience going through this process myself with the Indian consulate. My country of birth has similar rules, and my children were born before I acquired US citizenship.
