  • L2 working remotely for Canadian employer

    Hello everyone,

    My husband and I are both Canadian citizens, and he may be transferred to the US for work. He will be going under L1, which means I will accompany him on an L2. Thing is, I currently work for a Canadian company here in Canada. I know that if I go to the US on an L2, I will be able to obtain an EAD that allows me to work while in the US. My question: do I still need an EAD if I am working remotely from the US for a Canadian company, being paid in Canadian funds into a Canadian bank account? Are there any other considerations I need to think about?

    Thanks in advance for any help or guidance anyone has to offer.

    Yes you need the EAD. no there is nothing else to stress about other than US tax filing requirements and foreign account disclosure rules.

      Thanks so much, inadmissible. Follow up questions: do you see any hassles in getting an EAD approved? Also, have you any idea of the time frame involved? Need I be physically IN the US in order to apply for the EAD? I ask the last question especially because I'm trying to minimize the time between my moving and my continuing work for my present employer, albeit remotely. Likely my husband will go ahead and the children and I will follow...

        You have to be physically in the United States, admitted as a L-2, in order to apply for EAD. It can take as long as 90 days, but you will likely get it sooner. I am not certain if you have to stay in the United States while the application is being processed.

            Hi,

            I am also in a similar boat except that we are still Permanent Resident (applied for citizenship).
            OP - How did it work out for you? If you or someone else can answer below questions, that will be extremely helpful:
            1. Did you continue to work for your Canadian employer remotely while staying in US and awaiting EAD?
            2. Did you leave US after applying for EAD and continued your work in Canada while waiting for EAD?
            3. Any other inputs/feedback/learning?

              I'm sorry, I didn't see your question until just now. We still haven't moved: we will be moving next month. I will post once we have moved, and let you know how things went.
