  • Question regarding L1B reset and Petition Expiry Date

Hi, My L1B maxed out on January 21, 2015. I returned from US to India on the same day. The Visa stamping in my passport says the visa is valid until April 2018 but the visa stamping also has PED as Jan 21, 2015. I assume PED refers to Petition expiry date. I am also under the assumption that my L1B gets reset on Jan 21, 2016 (after 365 days outside US). Can i travel back to US after Jan 21, 2016 with the same Visa stamping? Do I have to file for a petition extension? Or Do i have to get new L1B stamping. Please let me know the procedure to travel back to US after Jan 21, 2016.

You need to first get yourself a new petition with validity from Jan 21 2016 onwards. I would suggest you get yourself a new visa too with the new petition.

This is my opinion not legal advice.
