    Hi,

    I am on L1B(Blanket). My visa expires on Aug 30th 2015. My I94 expiry is also the same date. My company has applied for my extension on May 25th. Now, my petition is on RFE. I am working on with our company's legal team to provide the further evidence.By July mid, my wife and son are planning to come back to US from their vacation in India. My wife is on L2, her visa expires on Aug 30th 2015 as well. My son is a US citizen. I need information on the below so that I can make informed decision.

    1) What is the odds of getting my L1B approved/rejected?
    2) Is it advisable to defer my family's travel to US?
    3) Will my family be questioned upon arrival on why would they need to come to US while there is hardly a month left in the current visa? (I can have my wife keep the L1 Renewal receipt notice from USCIS for the proof of extension being applied).
    4) How long will my wife get I94 upon arrival, is it until Aug 30th 2015 or longer than that, what is the odds of getting longer I94?
    5) If I visit a nearby country and return back to US in the mid July, will I have problem upon arrival since I hardly have 1 month left in the current visa, what is the odds of getting an extended I94? Is this approach advisable so that I may get longer I94 so that I can stay in US irrespective of my L1 extension's outcome.

    Questions in RFE :
    · Please describe in layman's term what the (System) does and how (Client) is using the system.
    · What type of modules or sub applications are parts of the system?
    · Please briefly describe each subsystem or module.
    · Any part of the system has the employee created/developed? If so please explain.
    · Please describe why the employee is a superstar on the project (for example, is there a particular subsystem or module that only he is working on? Or perhaps is he the only guy knows all the subsystems?
    · Detailed Job duties in the US.
    · Number of employees working on the employee’s project in the US?
    · Number of employees working on the employee’s subsystem in the US?
    · Is the employee training any employees on this system? If so please provide names.
    · Number of employees working on the project in India?
    · Number of employees working on employee’s subsystem in the India?
    · Any literature on the system (Work Order, Brochure, Project presentation) that shows ABC is working on the system.

    1) Would depend upon how convincing your/your employer's response is to the RFE is.
    2) I dont see a reason.
    3) They most probably would not be.
    4) It depends upon the officer, recent trend has been to issue only till Visa expiry/passport expiry.
    5) You should have done that prior to filing extension. Even if you leave now, and return, if in future the petition is denied , based on last action rule you would have to leave.

        I have received similar questions on my L1B extension.. I am in the process of responding too..
