  • L1 visa - 2 years on entry

    Hi,

I have a question on the L1 visa stamp on entry.

I was issued a 3 year L1B visa, however when I entered US, the stamp (I-94 record I believe) was made for only 2 years.

What are my options to get this updated to 3 years?

If I travel to India or another country during this 2 year period and then come back to US, which I get another I-94 stamp which may update it to 3 years?

Wonder why you got I-94 for only 2 Years. Is your passport expiring in 2 Years or the Petition Validity/I129 validity is only for 2 Years?

This is my opinion not legal advice.

No my passport does not expire in 2 years. Where can I check the validity of the I129. It was a blanket petition.

It would be on the I129S that your employer would have given you and would have been stamped by the Consular Officer while approving your visa. Normally one takes 3 copies, and VO stamps 2 or 1 and asks you to show at the POE.

If your visa expiry, PED date, I129S date and passport date all are valid for 3 Years or more I dont see a reason why you got I94 only for 2 Years. If you take a print out of the online I-94 page and suporting documents (I129s, I797, passport) to the local CBP office they may be able to correct it.

Thanks. If I leave USA and come back will this stamp be updated to 3 years?

Most probably, but why not just try going to nearest CBP and see if they would correct it?

Thank you again. It may seem like a dumb question, but is it safe to visit the CBP office and it will not have any negative implications. I just feel a little uncomfortable going up a visa authority office. I could check with the visa lawyer that our company has.
