  • I-94 Status post L1-B Extension

    Hi,

    In a week time, my company will start the processing of getting my L1-B VISA to be extended. Once the L1-B VISA extension is approved, will the I-94 gets extended as well OR do we need to do that separately to ensure that the I-94 is having the valid date.

    Additionally, filing an extension for L1-B, do we need to travel to India? My understanding was that no need to travel to India to file the L1-B extension, we can do it while we are in USA itself.

    I assume you are in the US in L1B status and your employer is filing a petition with USCIS. In that case, they are precisely extending the petition and your I-94. That allows you to live in the US and work.

    If you leave the US and want to return, you will still need to get a Visa.

      Visa extension, petition extension and stay extension are three different things. Normally if your petition is extended, the I-94 would also be extended and the extension approval notice I797 would have a new I-94 as lower part of the I797. This is enough for you to continue work and stay in the US. You have to understand that this extension allows you to continue to stay and work in US but merely having this extension does not entitle you to leave US and return without first going for a new visa stamping. In order to leave US and return a new visa would be required. You get a new visa in the same process as you originally got it, fill DS-160, pay fees, schedule appointment, and attend interview at US consulate outside US.
