  • Shall I file L1B extension or initiate a fresh L1

I am in Houston, USA on L1B visa. My visa will expire on Nov 2015 and my i94 is valid till Feb 2016.

    Now I have two option:

    1. To go for visa extension, but I have heard visa extension success rate is very low.
    2. To apply a fresh L1B visa, but in this scenario, they might ask me why did not I file an extension as I'll be continuing for the same company, same client and same role.

Please suggest, which option(out of above two)has more chances of approval.

I know the chances are much much more, if i file for L1 A but I need to check with my company if they'll file L1A for me.

My company has also filed GC for me and they will be submitting it to DOL next week. Will this GC filing help me in my L1B extension/ Fresh L1B.

Does a fresh L1B filing affect my GC?

I am in similar situation but my L1-B visa expires on 17 Feb 2016.

I consulted with my lawyers and they don't recommend to file an extension. They say that the extension for L-1B visa are currently in 50% denial rate, which is quite high. They can still file it but then you will need to rush if they are not approved.

So the decision is now to go overseas to renew it, however the lawyers again told me that is a time limit for US consulate to accept a renewal, however we were not able to get that information neither calling to the consulates or via my lawyers.

Now I am worried that if I applied for a new visa and is not renewed then we will be in trouble.

Regarding the GC processing. DOL is also applied for me and that takes 6-10months to get approved. During that time that does not help us to stay legally in the US, this is only a paper to be able to apply for the GC. I think during I-140/I-485 application we are in a better position to stay.

L1B blanket denial in USA, Should i file fresh L1B or same L1B extension from India.

My L1B blanket extension is denied in USA and i had to travel back to India. Now i wondering whether i apply for a fresh L1B blanket or extension of same L1B blanket. I completed 3 years on my first L1B blanket petetion. I am worried that i recently faced a rejection of L1B extension. What visa category to apply for high chances of approval. I am in India now and my visa got rejected on Nov 14. Simultaneously i am filing my H1B also, but that has time untill March.
