    Dear All,

    I work as Senior Analyst for a large international company (parent company) in Germany for more than 3 years.
    And now I am offered a managerial position in the company's office (sister company) in the US.

    Accordingly, I have two questions:

    1) Do I qualify L-1A visa based on the fact I am employed in specialized knowledge position abroad for one year in the last three years and coming to the US to assume a managerial position?

    2) If so, will L-1A received under the mentioned above conditions help to qualify for Green Card (compared to H-1B or L-1B)?

    I have just found the following information on this web site :



    As long as you were employed in managerial or executive position for one continuous year in the preceding three years (in U.S. or outside of the U.S.), you can apply for green card in EB1C category immediately. Therefore, if you were already appropriately employed before entering the U.S., you can apply for green card immediately. Otherwise, you will have to be on L1A visa status for one year before applying for green card in EB1C category. The later would be the case if the alien is currently on L1A visa but was employed abroad as specialized knowledge professional.

    Do I understand it correct - that a person can get L1A even if he was employed abroad as specialized knowledge professional, not managerial one?
    Then after a year of working in the US in managerial position with L-1A visa, the person can qualify for EB1C?
    Do I understand it correct?

    I addressed the same questions to a lawyer in the US (and showed him the information from this website) and he replied that to qualify for EB1C one has to be employed managerial capacity at least for a year in preceding three years abroad before entering the US. And specialty knowledge is not enough for L-1A.
    In other words, completely opposite to what is mentioned on immihelp.com website.

    Please assist in clarifying the situation.
