L1 Maxout : Can H1B possible

All - I am on L1A and nearing Maxout. My employer says that as per new policy I am not eligible to file H1 . I will need to be out from US for 1 year to apply .

My i140 is approved already.

Please provide anybody's experience and provide ur inputs. Very urgent...

Your HR seems to be right. L1+H1 can at max be for 6 Years, if you already reaching L1A maxout, then you would not be eligible for fresh H1 immediately, you need to stay out of US for 1 Year.
