    Hi, I converted my L1B extension RFE to premium process, i believe generally it will take 15 working days to get the response from USCIS, my question is

    1) I have approved H1B petition for this year, if it is denied how soon i can come back to US, is there any time frame do i need to be in India?
    2) is there any chance for L1B RFE approval?

    1. I am assuming it is h1B consular process not a COS. If L1 extension denied , you can leave US and go for H1 stamping and return, no time frame as such of staying in India.
    2. It depends what the RFE was about and how convincingly it was responded to.

      Thanks Raghvi, I am not changing Company same company filed for H1B and got selected in Lottery in May 2015, hope if L1B denied i can leave US and get H1 Stamping asap correct?

        Was h1 processed as COS or as consular process? If as COS and approved with new I-94 then you may already be in H1 status.

          Since my I94 got expired on June and I applied for L1b Extension, my attorney said if L1b Extension denied i need to go back and stamp H1, so if it is denied no time frame correct, i can stamp H1 and come back within 15 or 30 days?.
