Need urgent suggestion on L1B extension
Hi All,
Below is my case -
My L1B visa (first 3 years) expires on June 13 2016. My I94 also expires on the same day. My company 'A' wants me to file for L1B extension now so that I get a result before June.
However company 'B' wishes to sponsor my H1B for the year 2016-17.
1) In a change of status scenario where the decision on L1B extension is still pending and my H1B is approved. I understand on October 1 2016 I will have to start working with company B.
- What if my L1B extn is approved now after this and company A has not withdrawn L1B extn? Do I have to go back and work for employer A again?
2) If I get a negative decision on the L1B extension before June 2016 but my H1B gets picked up in the lottery. Can I request company B to alter the H1B application from COS to counselor processing? So that when my visa expires I can be outside US for 3 months before returning to the country again in October H1B stamped.
3) Is it advisable to delay my L1B extension filing to just a month before my current L1b visa expires?(i.e. till May 2016). I believe if the decision is pending from USCIS then we can still stay 240 days in US. Won’t it make sense to delay the L1B extension filing as it will be give more opportunity for getting a COS if H1B gets approved?
4) My spouse who is on L2 has her EAD approved till my L1B visa expiration date i.e. till June 2016. In a case where L1B extension decision is pending from USCIS can she still continue working on the expired EAD? Or can she apply for the extension of her EAD on the basis of pending L1B extension application?
How are the L1B extension approval trends from USCIS and what is the average time taken for granting the approval? What do you recommend the best approach considering my scenario?
