  • L1A to GC

    Hi All,

I have some queries related to applying for a GC. I have a fresh L1A Blanket visa which I have not utilized till now.

I have some queries as below:-

    1) Can I or my employer file for a green card in EB1 category from offshore itself when I am not in US.

    2) If I land in US when can I start the GC process. I mean, do I need to wait for some period before asking my employer for filling a GC. I want to know if my chances of getting a GC are more when my visa is about to expire or it is same even if I apply once I land in US.

    3) If my employer agrees to file my GC once I land in US, approx. how much time will it take in EB1 category.

Any help appreciated on my above questions!! Thanks!!

      1. Yes.
      2. You cannot unilaterally start , the employer has to do it. No wait period as such from immigration point, but internal company policy might have some wait period.
      3. 6-12 Months if no audit/RFE.

This is my opinion not legal advice.
