Have valid L1 visa but petition expired on 1st Oct 2015

    Hi All,

    I have a valid visa till Oct 2017 however my PED was 1-Oct-2015.
    I have applied for extension which is currently in progress.

    My wife has valid visa till 5-May-2016 with same PED date.
    She needs to travel to India this week due to family emergency.

    My question is that, if my petition gets extended (it has now changed to Premium Processing), can my wife travel back with the current visa & my new extended petition?
    Or will she still need to go for new visa stamping before travelling?

    At the time of entering into USA, you need to have a valid visa & associated valid petition.

    So, she can enter into USA before 5th May 2016 on her current visa & your new approved petition. Beyond that, she will have to go for re-stamping of her visa.

      What is the process for upgrading to premium extension? i heard there are denials for L1B petition extension?

        Hi ,

        I am also having the same issue. my question is if I129s gets denied? is there any way to get my family back to US? can we reapply for extension?
