EAD renewal while L1B extension in process

  • EAD renewal while L1B extension in process

    I'm on L1B visa & I94 expiring on Dec'2016 & Soon initiating the extension process. I understood there are delays in getting the extension.My questions are as below.

    1.How long USCIS to approve L1B extension ? both for Normal & Premium on approx scale.

    2. Is there a possibility to extend I94 while visa extension is in process ? (L1 max out May 2019)

    3.My spouse is on L2-EAD working currently in U.S.His EAD expiring in Dec'16 on day of Visa and I94 expiry( But his I94 & Visa good till May'2017). My spouse has to apply for EAD extension by August 25th-2016 (120days before expiry).Will it be possible to apply EAD renewal while L1B extension in process ?

    1. 3-6 Months for Normal processing, if no RFE. 2-4 Weeks for premium processing, if no RFE.
    2. The L1 B extension if approved will come with new I-94. The only other way to get a new I-94 is to leave US, go for fresh l1 stamping outside US and re enter on new visa, thereby getting new I-94 as per new visa.
    3. It will be possible to apply, but I would suggest you apply L1 extension in premium so that you get the L1 approval before 25-Aug-2016.

        Hi,

        Now my company is recommending me to opt for L1-B Extension and they have approved for premium processing.

        But what I hear from friends and colleagues is that L1-B extension success rate is only 50%.

        I want to know if I would be able to apply for L1-B New immediately, if my L1-B extension gets rejected while my I94 remains valid till Dec 2016.

          For that you will have to leave US and go for fresh L1 stamping.

            Hi guys,

            My understanding is in case when L1 B extension is in process and outcome is still pending from USCIS. Which they take 3-6 months to process and arrive at an outcome. Incase you filled for L1B extension and your I-94 date is going to surpass before you anticipate USCIS to provide the outcome, your company's attorney can file for I-94 validity extension - pending L1B extension outcome.

            Please talk to your employer and seek guidance.

            And do share what your employer advises.
